New laws for Concealed Handgun License (CHL) program

Summary of new laws passed in the 84th Regular Legislative Session that impact Concealed Handgun Licensing.

Open Carry

House Bill 910 Effective: January 1, 2016

Caption: Relating to the authority of a person who is licensed to carry a handgun to openly carry a holstered handgun; creating criminal offense.

General Information:

  • Authorizes individuals to obtain a license to openly carry a handgun in the same places that allow the licensed carrying of a concealed handgun with some exceptions. (See “Exceptions” below for more information.)
  • Unconcealed handguns, loaded or unloaded, must be carried in a shoulder or belt holster.
  • Individuals who hold a valid CHL may continue to carry with valid existing license.
  • A separate license will not be required to open carry. No additional fee will be required.
  • Individuals currently licensed will not be required to attend additional training. Training curriculum for new applicants will be updated to reflect the new training requirements related to the use of restraint holsters and methods to ensure the secure carrying of openly carried handguns. The new curriculum will be required for all classes beginning January 1, 2016.
  • The eligibility criteria to obtain a license to carry do not change.
  • The department will be updating website, forms and training materials to reference License to Carry (LTC) instead of Concealed Handgun License (CHL).
  • Changes to the laminated license are being developed and will be implemented at a later date.


  • Private businesses may post signs to indicate entry on the property with a handgun by a license holder is forbidden.
  • Penal Code Section 30.06 provides the language to be included on signs to indicate license holders are forbidden to carry concealed.
  • Penal Code Section 30.07 provides the language to be included on signs to indicate license holders are forbidden to open carry.
  • Posting of both signs is an indication by the business that license holders are forbidden to carry concealed or openly.


  • Open carry is not permitted by a license holder regardless of whether the handgun is holstered:
    • on the premises of an institution of higher education or private or independent institution of higher education
    • on any public or private driveway, street, sidewalk or walkway, parking lot, parking garage or other parking area of an institution of higher education or private or independent institution of higher education
    • by an individual who is acting as a personal protection officer under Chapter 1702, Occupations Code and is not wearing a uniform

Campus Carry

Senate Bill 11 Effective: August 1, 2016

Caption: Relating to the carrying of handguns on the campuses of and certain other locations associated with institutions of higher education; providing a criminal penalty.

  • Authorizes a license holder to carry a concealed handgun on or about the license holder’s person while the license holder is on the campus of an institution of higher education or private or independent institution of higher education in this state. Open carrying of handguns is still prohibited at these locations.
  • Authorizes an institution of higher education or private or independent institution of higher education in this state to establish rules, regulation, or other provisions concerning the storage of handguns in dormitories or other residential facilities that are owned or leased and operated by the institution and located on the campus of the institution.
  • Requires the president or other chief executive officer of an institution of higher education in this state to establish reasonable rules, regulations, or other provisions regarding the carrying of concealed handguns by license holders on the campus or on specific premises located on the campus.
  • Authorizes posting of a sign under Penal Code Section 30.06 with respect to any portion of a premises on which license holders may not carry.
  • The effective date of this law for a public junior college is August 1, 2017

Various Other Changes

House Bill 554 Effective: September 1, 2015

Caption: Relating to a defense to prosecution for the offense of possessing or carrying a weapon in or into the secured area of an airport.

  • Amends the Penal Code to add a defense to prosecution if the actor possessed a handgun that he or she is licensed to carry at the security checkpoint of an airport, and exited the screening checkpoint for the secured area immediately upon completion of the required screening process and notification of possession of the handgun.
  • Adds the actor cannot be arrested for the sole offense of possessing a handgun that he or she is licensed to carry, unless a police officer gives the actor the opportunity to leave the area and he or she does not immediately comply.

House Bill 1376 Effective; September 1, 2015

Caption: Relating to the application of certain concealed handgun license laws to community supervision and corrections department officers and juvenile probation officers; reducing a fee.

  • Allows supervision officers and juvenile probation officers to establish proof of proficiency by a sworn statement that indicates the person demonstrated proficiency with a firearm instructor licensed by the Texas Commission on Law Enforcement within the 12 month period preceding the application for the license to carry.
  • This provision applies to supervision officers appointed or employed under Section 76.004, Government Code, to supervise defendants placed on community supervision.
  • Reduces the fee for a license to carry to $25 for these individuals.
  • Individuals applying under this special condition will be required to provide proof they are a supervision officer or juvenile probation officer.
  • A new fee schedule will be posted on the department’s website.

House Bill 2604 Effective: September 1, 2015

Caption: Relating to a concealed handgun license application that is submitted by a peace officer or a member of the state military forces.

  • Exempts applicants who are active peace officers from the requirement to submit fingerprints.
  • Repeals the provisions requiring a sworn statement from the head of the employing law enforcement agency regarding the applicant’s conduct and proficiency.
  • Regulatory Services Division (RSD) is in the process of updating the online application checklist. Until the online application is updated, peace officers may disregard the notations requiring fingerprints and the sworn statement from the head of their employing law enforcement agency.
  • Updated application instructions for peace officers will be posted on the department’s website upon the effective date of this law.

House Bill 2739 Effective: September 1, 2015

Caption: Relating to the use of a concealed handgun license as valid proof of personal identification.

  • Amends the Business and Commerce Code to require businesses to accept a concealed handgun license (CHL) as a valid form of personal identification for access to goods, services, or facilities.
  • Does not affect laws requiring a driver license to operate a motor vehicle.
  • Does not effect the existing requirement to present a driver license when renting a car.
  • Does not affect the type of identification required under federal law to access airport premises or to pass through airport security.

House Bill 3710 Effective: September 1, 2015

Caption: Relating to a voluntary contribution to the fund for veterans’ assistance when applying for a concealed handgun license.

  • Requires DPS to offer CHL applicants an opportunity to contribute money to the fund for veterans’ assistance when applying for an original or renewal CHL license.
  • The applicant will determine the amount of contribution.
  • RSD is in the process of updating the online application to accept contributions. More information will be posted here when the option to contribute is available.

House Bill 3747 Effective: June 16, 2015

Caption: Relating to the issuance of a concealed handgun license to certain retired judicial officers.

  • Authorizes retired federal judges to receive a discounted CHL in the same manner as a retired state judge.
  • The reduced fee is $25. A new fee schedule will be posted on the department’s website.

Senate Bill 273 Effective September 1, 2015

Caption: Relating to certain offenses relating to carrying concealed handguns on property owned or leased by a governmental entity; providing a civil penalty.

  • Prohibits a state agency or political subdivision from posting signs stating where CHL holders are prohibited from carrying a concealed handgun on the premises, unless specifically prohibited by Texas Penal Code 46.03 and 46.035.
  • Provides a civil penalty to a state agency or political subdivision if falsely notifying a CHL holder that entering or remaining on certain governmental premises, leased or owned, is illegal.
  • Limits the scope of the governmental meeting prohibition by restricting it to the specific room or rooms in which the meeting is being held, and to public meetings for which notice is required under the Open Meetings Act.
  • Provides an opportunity for the agency or subdivision to cure the violation within three business days of receipt of written notice from a citizen.
  • Complaints of a violation are reported to the Attorney General Office.
  • Provides the Attorney General must give notice to the agency or subdivision and provide an opportunity to cure the violation before a civil penalty is imposed.

I tried to tell them that the quote was wrong, out of context or that they just don’t get it. maybe even they are not capable of understanding a great mind like Rush. the fact that was very clear is they do not listen to the Rush limbaugh show, and get their info from places like cnn, huffpost, media matters or straight from the other #stopRush crowd.  I highly doubt that any of them have the courage to come here and see the truth or even try to find the truth herein contained. It takes thinking for that to happen.


Revenge on the Bitter Clingers


RUSH:  I’m gonna take a stab at answering my question.  Obama is literally pushing people to snap, attacking the very sanity of the country.  To what end?  Aside from wanting everybody’s name on a list of some kind, why is Obama doing all of this?  I mean, all of this is so in our face.  Everything that people hold dear is under assault, deliberately making people upset.  This is not what presidents do.  Deliberately making people upset.Maybe this is about revenge.  You know, Obama used that word when he was on the campaign trail prior to the election.  He told his supporters in Ohio to go vote and get their revenge.  Revenge against who?  Well, obviously, the people that disagree with Obama.  But who are those people?  He clearly knows who they are, and I think the root of this, I think the answer to my question can be found in the comment that Obama made when he thought he was off the record at a fundraiser in San Francisco, when he talked about the bitter clingers.  These are people that the liberals all know.  These are the not very bright people that want life to never change.  They don’t want any progress.%image_alt%They want to remain cloistered in their archaic, antique past, and when things don’t go right, when there’s too much change, when there’s too much progress or progressivism, like when there’s civil rights laws, they don’t like it. When there’s gay rights and gay marriage, they don’t like it.  When there’s all kinds of cultural rot on TV, they don’t like it.  And so what do these people do?  They get bitter, and they cling to their guns, and they cling to their religion.  They cling to their antipathy for people that don’t look like them, and this would include minorities and immigrants and so forth.  Maybe it is that that’s who Obama wants revenge on.  Maybe he has an active dislike for the people he calls the bitter clingers.

That birth control mandate was revenge on the bitter clingers. People clinging to their religion when things are happening so fast around them they don’t understand and they don’t like, so they cling to their religion as though being religious is clinging to something.  When people move in that don’t look like them and don’t like them, they cling to their archaic sexist and racist views, and they grab their guns or what have you.  Here’s what he said.  He said, “It’s not surprising then they get bitter, they cling to guns or religion or antipathy toward people who aren’t like them or anti-immigrant sentiment or anti-trade sentiment as a way to explain their frustrations.”

And if you noticed now, Obama has found a way to get back at ’em on every single point.  He is in their face on guns.  He’s in their face on religion. He’s in their face on immigration.  Amnesty by executive order was revenge on those who don’t like immigrants, in his view and the view of a lot of leftists.  You people in Kentucky, for example, you in the hills of Kentucky and West Virginia and in Georgia and the Carolinas, down there in Mississippi, Alabama, you people, you’re the ones, you don’t like all this change so you cling to all these old-fashioned standards.  And you’re holding this country back from moving forward, being modern and so forth.

Maybe that’s it.  But clearly he has animosity for these people that he calls the bitter clingers, and everything he’s done has been in their face.  It really has.  And it continued today with this massive new effort now to stop gun violence, which is what they’re now calling gun control.  I want to go to the audio sound bites here.  Let me go back and replay the NRA ad that has the left in a tizzy.  Well, they were this morning.  They’re a little mollified now that Obama has spoken, but the NRA took it right to Obama.

ANNOUNCER:  Are the president’s kids more important than yours?  Then why is he skeptical about putting armed security in our schools, when his kids are protected by armed guards at their schools?  Mr. Obama demands the wealthy pay their fair share of taxes.  But he’s just another elitist hypocrite when it comes to a fair share of security.

RUSH:  Ooh, you don’t do that.  You don’t call Obama an elitist hypocrite.  His kids are more important than yours, and you should damn well know that.  You should respect that.  His kids are more important than yours.  He’s Barack Obama.  He’s more important than you are.  You ought to understand it’s okay for him to do whatever he has to do to stay safe, ’cause he’s our leader.  We’re nothing without him.  And he’s nothing without his family.  You’ve got to understand that.  We can lose your kids.  We can have your kids get kidnapped, and that’s one thing, but not his kids. Oh, no.  The country can’t put up with that.

A bunch of leftist bloggers actually started tweeting things that I just said.  His kids are more important than yours.  Yes, they are.  He’s the leader.  He’s a Dear Leader.  He’s entitled to better food than you have. He’s entitled to more travel, better travel. He’s entitled to a nicer house than you, because we all need him.  That’s what they think.  Here is the state run media in lockstep on this.

NORAH ODONNELL:  The NRA gets personal against the President.

JON KARL:  A harsh, personal attack on the President.

SAVANNAH GUTHRIE:  An ad that gets very personal.

JOHN DICKERSON:  It’s already pretty personal.

CAROL COSTELLO:  It’s personal now, a new NRA web ad makes no bones about it.  We’re going for the jugular.

RUSH: See, Obama’s never personal. His bitter clinger comments, that’s not personal. When he mocks and makes fun of people who aren’t like him, that’s not personal. When Obama says he doesn’t know what’s in Rush Limbaugh’s heart, that’s not personal. When Obama says whatever he says about the NRA or whatever he said about Romney, that wasn’t personnel. Calling Romney a felon in his campaign, accusing Romney of heartlessly standing by while a man’s wife died from cancer?

It’s not personal! No, no! See, Obama’s never personal. Obama’s the essence of a wonderful spirit. He’s the essence of perfection. The NRA, that’s getting mean and nasty and personal now. So Obama can say whoever or whatever about whoever he wants, and it’s just the way it is — and you better damn well agree with it. If you don’t, and if you voice your disapproval, you’re “getting personal,” and that makes you a target. You don’t do that. Not at all.

CALLER: Oh, thank you for having me on. Okay, gun violence is gun control. I like the comments of the children standing behind him and writing the letters. But are they the same the children who wrote letters to Santa Claus, hoping that he’s gonna bring them toys and gifts, that Santa Claus who isn’t real? So we’re gonna put our thoughts or our hopes behind…?

RUSH: Are you questioning the president’s commitment to the safety of those children?

CALLER: I’m questioning the president’s reality. If he really wants to stop gun violence or reduce gun violence, it’s gonna take more or something different than gun control because controlling guns means only the law-abiding citizens will not have guns. Drug dealers will have guns, terrorists will have guns, crazy people will have guns.

RUSH: That’s true. I’ve often wondered, what is so hard for the left to understand about that? By definition, if you have gun control laws, the law-abiding will be the only people that don’t have guns. In fact, the most stringent gun control laws in the country today are DC and New York and they’ve got the highest crime rates with guns. Doesn’t that tell them something? So it must be something not to do with guns. It’s gotta be about something totally different than gun control.


CALLER: I think it does. It’s just terrible that 26 people died in Sandy Hook and 20 of them were children. Terrible. Very sad, coming up to Christmas. Hopes and dreams the young children had, their parents and weddings and congratulations that will never occur. However, on any given day in America, more than 3,000 children are killed from abortion, and we have no problems with that. We’re okay with that; it’s not an issue.

You can’t spend 40 years telling people and telling children that if I make a mistake — if something comes up and this child that I don’t want is in the way of my future and the way of me graduating high school, is in the way of me going to college, is the way of me being happy, is in the way of whatever I want out of life — then it’s okay for me to kill the baby. But later on when I become a disgruntled employee, when I become an unhappy student at school because children are bullying me, then I want to eliminate them to get them out of the way? It’s the same concept.

RUSH: Well, it’s a good point. You know how to stop abortion? Require that each one occur with a gun.

A dad posted to Twitter a screenshot of what he said was a multiple-choice question from his son’s high school health test.

The question asked for a definition of “family.” His son chose “a collection of related-by-blood individuals living together.”

But that was the wrong answer. (click pic for twitter post)


The correct choice? “A collection of individuals who care for and about each other.”

Will Saleton said his son was marked down 5 percent “because he chose this ‘incorrect’ definition of family.”

Some responders to Saleton’s post noted that mothers and fathers aren’t related by blood and that many parents adopt, which would make his son’s choice incorrect anyway. Saleton and others noted that often kids are too young to “care for” adults in a household, which makes the “correct” answer insufficient.

One responder noted that the “correct” answer “reduces family to any group of strangers.”

Video: See What Happens When Adults Are Subjected to Common Core Math | Video |

Caleb Bonham, editor-in-chief of Campus Reform, recently took to the streets of Boulder, Colorado, with the specific purpose of frustrating people with Common Core math. Needless to say, he accomplished his goal.

Apparently using an actual Common Core math problem, Bonham used a small dry erase board to walk unsuspecting individuals through the steps — and there are many.

After finally solving the simple subtraction problem, Bonham asked the participants if the Common Core method represents the most efficient way to teach mathematics to the next generation of students.

“No,” one man responded immediately.

“It’s inefficient, you’re wasting time,” another said.

One woman, who was holding a baby who could theoretically be required to learn Common Core-style math in the future, simply said, “I don’t like it — at all.”

Michelle Obama warned readers in an an op-ed for The New York Times on Wednesday that, “Right now, the House of Representatives is considering a bill to override science by mandating that white potatoes be included on the list of foods that women can purchase using WIC dollars. Now, there is nothing wrong with potatoes. The problem is that many women and children already consume enough potatoes and not enough of the nutrient-dense fruits and vegetables they need.”

So much for being pro-choice. But isn’t that such a fun phrase, “override science”? Both in its predictable use and its lack of sensible meaning. You can’t override science, so why is she claiming a House bill does so? You can override “scientific consensus,” which is itself an unscientific idea, but not science. It’s a nice, frightening buzz-phrase, though, logic be damned.

If you disagree with a Democrat, you hate science. You also hate children, hate women, hate clean water (personally, muddy drinking water is my favorite), hate nature (yay, litter!), hate Earth, hate non-whites and non-straights, hate the elderly, and hate children with Down’s Syndrome. There’s no arguing with Democrats. If you disagree with them, there is no possibility for civil discourse. You are simply labeled a hater and a cretin, and that gives the Democrats a good enough excuse not to engage in civil discourse or debate with you. “I don’t need to justify myself to a hate-monger.” It’s really convenient, being a Democrat.

So Republicans want to override science, Michelle tells us, because they want to allow women who are receiving Women, Infants and Children (WIC) assistance the choice to purchase white potatoes. This is like saying that if I have a sweet potato and I have a white potato, and I tell a woman, “Here, take either one,” I am overriding science. Giving someone the option to buy white potatoes is anti-science, according to Michelle; science, she believes, does not allow room for freedom of spud choice.

CALLER:  Hi, Rush.  I really do appreciate you taking calls, giving the few the opportunity to speak to the millions.

RUSH:  Well, I’m glad you waited.  I appreciate your patience.

CALLER:  I gotta also give you a huge pat on the back, too.  I’m not sure… You know, fame, it doesn’t come in one flavor that everybody wants a piece.  What you’re doing is really a courageous thing for truth, simply being truthful. It’s quite a burden that you have to carry to do that.  I really appreciate it.  But the point I wanted to make, Rush, was that the problem that’s going on in this country right now is broken hearts.

These people, these dysfunctional females are making these young people. Everyone starts off with youth, and if they don’t have a father who’s showing them how to do life, they want to cling to anything. They really do trust Obama, period! They trust him, and, let me tell you, they’d reelect him.  I know.  I live and work with these people.  They really would reelect Obama right now.

They don’t care about the Constitution.

They don’t care about how many people died for them to have the right to do anything that’s going on around them.  It’s an every-man-for-himself existence that they live right now, and it really is a sad thing.  If people looked at it from this point of view, the people who have had Pops… God bless him. Like you’ve shared so much of your life, your personal life with us, Rush.

Not everybody had Pops in their life.  I did have a strong moral father in my life, but that’s where we learned how we don’t have to be afraid, and then where did we learn our morals from? We learned it in the church! There’s a whole other thing that young people and people in general want to stay away from because that’s the place where people gonna get judged.

RUSH:  I know.

CALLER:  There’s no judging these people. That’s like a personally attack!

RUSH:  I know. People have not been taught to take risks. They have not been taught to learn how to get along on their own.

CALLER:  They’re scared to death, Rush, and they trust Obama.  You know, it’s not happening by accident, this whole Obamacare thing.  It’s not called the Affordable Health Care Act for nothing.

RUSH:  I know.  It’s called the Obama phone.  It’s called Obama stamps.

CALLER:  It’s because they trust him.

RUSH:  Well, look, that argument that he made is irrefutable when applied certain people.  He’s basically saying that the breakup of the traditional family causes it. He’s focused on lack of father ’cause they’re the ones that vamanos mostly and the government comes right in and assumes the role of father — and it doesn’t just affect young boys, Eric.  Single women likewise end up looking at government as provider, protector, you name it.

None of the rest matters.  You exactly right.  “Constitution? The hell with that!  Free speech? I don’t care!  Where is my phone?  I don’t care! Where are my food stamps or whatever.  I mean, you gotta eat, and you’ve got to live, and I don’t care about the Fourth Amendment and searches and seizures. I don’t care!  Where am I gonna get my whatever?”  So I know.  That’s also by design, by the way.

The breakup of the family, you can trace it.  You can trace this.  You can trace it right back to 1964 and the Great Society and Lyndon Johnson.  You can trace it.  You can trace the bust-up of the family — you can trace the dissolution of black families, you can trace the rampant increase in poverty, you can trace the amount of money that has been transferred to deal with these inequalities and inequities — and you will see that all of this “charity” quote/unquote has just given rise to the need for more of it.

It hasn’t solved anything.

A Missouri-based gun manufacturer announced this week that it will release a line of “New York Compliant” rifles, a market-based response to the Empire State’s strict new gun laws.

“With the continual trampling of the 2nd Amendment in New York, Black Rain Ordnance is proud to announce their ‘New York Compliant’ rifles,” the group said in a statement on its website. “These rifles feature all of the quality and craftsmanship of the standard BRO-lines, but with the added features that allow for legal possession.”

Features that make Black Rain Ordnance’s new rifles compliant with New York’s guns laws include: No pistol grip, a non-threaded muzzle fixed stock, 10-round low capacity approved magazine and a Lo-Pro gas block “without the evil bayonet lug.”

And if Black Rain’s move to create rifles that comply with New York’s new guns laws, which have been described as some of the “nation’s toughest,” sounds familiar, it should: They’re not the only company to move in this direction, and stories of such guns have been popping up since May 2013.

In fact, several New York-based gun shops have, for example, offered to replace the grip on non-complaint rifles so that they’re square with state’s laws.

“The modified gun still fires at the same rate and with the same power; the shooter just holds it slightly differently,” the Guardian reported. “These modified weapons do not have to be registered with the state.”

One gun maker in Rochester, N.Y., Just Right Carbines, manufactures modified semi-automatic rifles that comply with the New York’s Safe Act, which was signed into law by Gov. Andrew Cuomo in January 2013.

Just Right Carbines’ general manger, Anthony Testa, told the Guardian that New York authorities signed off on the modified rifles, telling him that his products complied with the law.

The Safe Act, which was the result of the 2012 mass shooting in Newtown, Conn., that claimed the life of 27 people, bans the sale of so-called “assault weapons” and requires that everyone who already owns a rifle categorized as such to register them with the state by 15 April 2014.

The Safe Act singles out add-on features, including bayonet mounts, grenade launchers and, of course, “protruding pistol grips.”

Another New York company, H&H Firearms, has been working on modifying its semi-automatic rifles to meet state law.

“It’s basically an AR-15 without the features,” a lawyer representing H&H Firearms told the Times Union.

“People are champing at the bit” for a legal version of the popular rifle, said the company’s manager Justin Reickart, adding that the modified rifles look “like a paintball gun.”

 A male perspective on childhood sexual abuse…

People who have been abused deal with things in different ways, and we males are no different in that respect. For some males, the fact that someone has abused them will mean that they will then go on to learn boxing, karate or some other type of self defense. Often, although they become quite proficient at what they learn it never feels enough, and they will strive to learn more. Some males will feel that because they could not protect themselves from the abuse that they can never protect themselves. They will become timid and shy, easily picked on by others at school, which just goes on to reinforce how they feel about themselves. Other males, who are physically strong, often go onto using that strength to prove to themselves that they can now stay safe. Often these males will have problems controlling anger, more likely to suffer road rage, get into fights, etc.

Abuse blurs the emotional development of all people who are abused. Problems can arise when shame, guilt and anger intermix, something that is not at all uncommon for the male abuse survivor. Some males will use sport as an outlet for anger, some will use drugs and drink. Neither of these will work all of the time. The only way forward is to work through recovery. Talk about your anger. Talk about your feelings. Part of the problem is the anger that is felt at ones self for having been abused. By learning that the abuse was NOT your fault, removing the shame and guilt, anger does become easier to control. Part of recovery is to learn to identify your emotions. To learn the difference between been annoyed and been angry.

I use computer games as an anger release. I play Doom, and blast hell out of the monsters that I mentally paint the face of my abusers on. For me this is safe because I do realise that it is only a game, and not real life. I also fully realise the consequences of what would happen if I did such things in real life.

Obama Fans Can’t Believe Their President Wanted This to Happen – The Rush Limbaugh Show.


RUSH:  It was an LA Times story on Obamacare, and these are popping up more and more.  An Obamacare fan says, “Now I can’t sleep at night.  I can’t imagine this is how President Obama wanted it to happen.”  No matter what problems that they’ve had at the website or the exchanges, you can find some Obamacare supporters who’ve touted the relative success of some of the state exchanges.  One of the ones they point to is Covered California, as a success.

But now, people who have been able to sign up with Covered California, are discovering that doctors are refusing to see ’em. Doctors are refusing to treat cancer patients. This is another thing, folks. I can’t tell you how many times that I… I hate doing this. I hate, “See, I Told You So,” and I don’t want to be misunderstood with this.  What really frustrates me is this need not have happened.

This tragedy, this destruction of one of the greatest health care systems the world’s ever known, need not have happened.  I know it has, but it’s still tragic.  Some doctors are not seeing cancer patients, the doctors that are choosing to not be in network.  This is the thing that I spent a lot of time warning people about. Even if you are able to log in, sign on and enroll, some of you were gonna find out your doctors are not playing.

They don’t want any part of this.

They’re not gonna be the network.

Some of you, your hospitals are not gonna be in the network, the Obamacare network.

In fact, the top-tier hospitals across the country are pretty much all opted out of the network.  LA Times: “After overcoming website glitches and long waits to get Obamacare, some patients are now running into frustrating new roadblocks at the doctor’s office. A month into the most sweeping changes to healthcare in half a century, people are having trouble finding doctors at all, getting faulty information on which ones are covered and receiving little help from insurers swamped by new business.

“Experts have warned for months that the logjam was inevitable. But the extent of the problems is taking by surprise many patients — and even doctors — as frustrations mount.”  Now, this is where I run the risk of getting into trouble, but none of this surprises me.  It was all predictable.  This is how frustrating it is.  When you know that 2 + 2 = 4 and the country’s gonna act like it’s 5, would that not frustrate you?  I wish I could come up with a better analogy than that.

It’s just outrageous.  There was no way for this to fall out any other way than how it is, and they point to California as one of the successes.  Some patients plaintively say this is not what they were promised.  “Aliso Viejo resident Danielle Nelson said Anthem Blue Cross promised half a dozen times that her oncologists,” that’s cancer doctors, for those of you in Rio Linda, “would be covered under her new policy.

“She was diagnosed last year with non-Hodgkin’s lymphoma and discovered a suspicious lump near her jaw in early January. But when she went to her oncologist’s office, she promptly encountered a bright orange sign saying that Covered California plans are not accepted.” She went to her doctor, and her doctor isn’t playing.  She said, “I’m a complete fan of the Affordable Care Act, but now I can’t sleep at night. I can’t imagine this is how President Obama wanted it to happen.”

The truthful answer to that, Ms. Nelson…

I’m gonna assume you’re listening.  I’m gonna speak to you from my heart.  I’m just gonna tell you the truth.  I know you’re gonna reject it, and you’re gonna couple it with whatever you think you’ve heard about me from the media, but I’m gonna tell you right now, President Obama didn’t care.  He doesn’t even know you.  This is the kind of minutia and detail that he either just assumed would magically work because it was his idea or because were there competent people implementing it.

But, no. He knew that wasn’t the case because he knew his own website wasn’t working.  Oh, have you heard the latest on that?  How many times have you heard Obama bellyache and whine and moan about outsourcing?  His own is in Belarus — and that’s one of the reasons why it’s a security nightmare.  I’m not making it up., part of it is outsourced and is run by an outfit in Belarus.  Russia, for those of you in Rio Linda.

So, Ms. Nelson, I’m just telling you: President Obama doesn’t care.  What President Obama cares about is having the government in charge of and in control of the nation’s health care system — and what the president eventually wants is for you to only be able to solve your problem by going to somebody in government.  President Obama wants government to be looked at as a god by you or as an angel.

President Obama wants you and everybody he can convince to look at government as their only chance, as their last resort, as their first resort, as their angel, as their savior, as their guardian angel, guiding light, what have you — and if it takes a little pain along the way to get there? He doesn’t mind if you get mad at your doctor, by the way.  He doesn’t mind if you get mad at your insurance company.  In fact, the madder you get at your insurance company the faster he can get rid of that and have the government become your insurance company.

Now, folks, I’m really not persuading Danielle Nelson while I tell her this.  I know that.  I wish there was a way to do it.  But she’s out there, she wants the president to fix it. “Oh, gosh, if Obama knew, he wouldn’t permit this!”  He doesn’t care.  He’ll say he does, but this is so beneath the long-range objective here.  This is so minuscule in relevance to the long-term objective here, that it’s just one of the small prices to pay.  There gonna be glitches along the way to getting it right.

By the way, I expect if enough people have this problem, the president will try to find a way to blame it on the Republicans or George Bush.  Is it the wrong thing to say?  I mean, I could sit here and maybe try to reach her another way.  I could say, “Well, Ms. Nelson, this is exactly how it was designed to happen because of what the real long-term objective is.” That’s not gonna work.  She’s not gonna be persuaded by that.  This is a very personal issue.

This is what really rips me apart, folks, because these Democrats have turned all of this into the most important thing in people’s lives, and they’re out there playing with it like a political football and a game and a toy to be bandied about for votes — and as a tool to expand the size and scope and the reach of government in people’s lives.  “I’m a complete fan of the Affordable Care Act,” you shouldn’t have been,” and now I can’t sleep and I can’t imagine this is how President Obama wanted it to happen. “

Ms. Nelson, it didn’t have a prayer of working the way it’s designed, the way it’s implemented, and the people behind it, it never had a prayer of working.  The evidence is all around.  I cringe to see people used this way, their lives manipulated and toyed with.  Now this woman’s got non-Hodgkin’s lymphoma.  She doesn’t have any options.  They’ve been taken away from her.  She thought they were all gonna be amplified better than ever.  She probably believe that the Affordable Care Act was the cheaper health care act, and some of it was gonna be free but, whatever, it was gonna be plentiful.  I just hate what this is doing to people.  I just hate what this ideology does.  It rips families apart, it destroys incentive, founded on one lie after another.


RUSH:  No.  Here’s the thing about Danielle Nelson.  She says, “I’m a complete fan of the Affordable Care Act, but now I can’t sleep at night.  I can’t imagine this is how President Obama wanted it to happen.”  See, I feel sad for her, ’cause I think that’s a sad way of thinking.  “Oh, if only Obama knew, he would fix everything.”  It’s like when it’s discovered that somebody in Obama’s cabinet is a communist sympathizer, “Man, how’d that get past Obama?”  What do you mean, how’d it get past Obama?  It didn’t.  “If only Obama knew, he would fix everything.”  This is the way citizens of Third World banana republics think about their strongman dictators.  “Oh, if they just knew, I’m sure they didn’t mean it.  I’m sure they didn’t intend this to happen.”

If the reality of being turned down for treatment of cancer — folks, stop and think of this.  If the reality of being turned down for treatment of cancer can’t convince her, how can anyone?  What could anyone say?  So she’s not blaming Obama.  He’d fix it if he knew.  So somebody, in her mind, is sabotaging her health care.  Not him.  Maybe her doctors don’t want to give their services away.  Maybe the doctors want to charge too much.  Maybe Obama knows the doctors aren’t any good.  Who knows what she’ll come up with to explain this.


RUSH:  Tom in Spring, Texas.  Welcome to the EIB Network.  Hello, sir.

CALLER:  Good afternoon to you, sir.  It’s an honor and quite a privilege to talk with you today.

RUSH:  I appreciate you being here.  Thank you very much for that.

CALLER:  Everybody should realize when the CBO makes an estimate, they’re gonna be wrong generally most of the time. So if they’re saying it’s only two and a half million jobs to be lost, you can almost guarantee it’s gonna be significantly higher than that.

RUSH:  Well, let me tell you why that’s true, and with all due deference to the CBO, they are limited by law for projecting 10 years out.  That’s why the first 10-year projection came in the way it did.  They can only analyze the data they’re given.  They’re called bipartisan, but if you got a bunch of cheats and frauds giving them incorrect data, you’re gonna come out with gobbledygook, and that’s what happened.  We got a lie.  We got health care is gonna cost less than a trillion dollars.  We got premiums coming down, more people covered, all of it was a lie.  So now the 10-year period covers four years of implementation, and we’ve added an additional four years to the original 10, and that’s where they’re saying two and a half million jobs lost.  If you go another five years after that, using just the data now — you’re right.  The two and a half million jobs lost is gonna be even more.  That’s even more people liberated from the responsibility of working.

CALLER:  And when this happens, the people dropping out of the workforce, being pushed to part-time work or leaving the workforce, that’s gonna increase the premiums to the people and that’s gonna increase the cost to the government, so this is just another way to accelerate the economic collapse, and then it goes to intent.  And the intent all along, as you so eloquently put it, is what we’re seeing happen, because if this wasn’t the intent, they would make a change.  But not only will Obama not change —

RUSH:  See, that is the key right there, folks.  You know, you’d be charitable to say, “Okay, gross incompetence, people’s good intentions but didn’t know what they were doing and too embarrassed to admit it so they’re trying to make the best of it.” Or, it was intentional. Either way, there’s enough data, and not just on health care, but on every other economic policy, there’s five years of data now.  It isn’t working!  If they really wanted it to work the way the poor woman in the LA Times wants it to work, they would change it.  They would make the changes necessary to make it work.  Now, what are those changes?  Those changes would be admitting that they’re wrong.  And that is never going to happen because they aren’t wrong, because the sad fact is, this is the intent.  You can’t get around it.  There’s enough years now, like you say, if this isn’t the intent, change it, fix it.  Get it back on the right track.  No effort whatsoever to do so.

CALLER:  And not only that, but Obama has said, “If you won’t work with me, I’m gonna use executive order to move forward on my agenda.”

RUSH:  Exactly right.  And not only that, rather than admit it’s not working, they’re continuing to try to sell it.  They are bribing. I’ve got the story here. I put it in the middle ofthe Stack.  The way they are getting Millennials to sign up, I’ll give you the short version of this.  They are, 18-34, they are bribing some to sign up.  They’re paying Millennials if they succeed in registering new enrollees.  We have also found out — remember, ladies and gentlemen, when we learned that the National Football League was going to be helping the Regime? It turns out that the Obama administration sat down and wrote some bulk boilerplate tweets and Facebook posts and sent those to the NFL Players Association, the union, and the union just assigned them to random players.

The players themselves did not write those pitches.  They didn’t write those tweets or messages.  They didn’t write the salesmanship.  They just had their names attached to it.  So rather than take any step to fix it, they are continuing to try to sell it.  That’s what Obama’s constant campaigning is about.  They’re trying to sell this.  In other words, this poor woman, as identified by the LA Times: “Hang in there.  Hang in there.  It’s gonna work. We’re on the case. We’re gonna fix it.”  It’s fraud at the base minimum, what’s happening here.  But it’s all permitted in politics.  It’s hard to prove fraud in politics.  You indict the whole industry.

But you’re gonna have two things happen.  You’re gonna have 2.3 million fewer people pulling the wagon, 2.3 million more people riding in the wagon, 2.3 million fewer full-time workers will mean much lower taxes to pay for these and other government benefits.  The question remains, are the American people gonna swallow it?

See, I don’t think they are.  I think the polling data clearly indicates that they aren’t, but I don’t know what they can do about it.  Or, better stated, I don’t know what they think they can do about it, other than find a way to not participate in it for themselves.  It’s gonna be a free-for-all, you know, everybody for himself, which, in normal circumstances, would not be bad thing, but it’s just such a tragic thing.  It just didn’t have to happen.

Folks, this is not like lamenting the fact that Denver lost the Super Bowl.  “Oh, this didn’t have to happen.  Why, if Denver…”  This is a whole different thing.  We are in this circumstance because a giant fraud has been perpetrated on the American people by the political class of the country.  And what it’s doing to people and their lives… you take away the desire, necessity, to work, you’re effectively dehumanizing people.  You are taking away from many people one of the primary sources of their confidence, self-identity, reason for being, particularly in men, but in more and more women now with feminism and so forth making its giant strides.  It’s just a tragic thing here that’s happening, and it’s turning more and more people into satisfied wards of the state.

And when you have organizations like the New York Times come along, “Oh, hey, these two and a half million people, there’s nothing wrong here.  They have been liberated from the choice of having to be in a job they only had to have health care benefits.  Now, because of the brilliance of Obama, they’ve got their benefits, but they don’t have to be locked in a job they hate.”

Thomas Joseph Coyne earned his Doctor of Philosophy (Ph.D.) degree at Case Western Reserve University (Economics/Finance), his Master of Business Administration degree (MBA) from Kent State University (Management/Finance), his Bachelor of Business Administration degree (BBA) from Marshall University (Accounting/Economics). He completed his postgraduate work at the University of Chicago (Monetary Theory/Price Theory) and the University of Michigan (Computers).


As a full-time undergraduate student at Marshall University, Dr. Coyne worked full-time as a brakeman on the Baltimore & Ohio Railroad, graduating in three years time. He worked full time as industrial credit manager for The B. F. Goodrich Company while a graduate student at Kent State University, graduating in two years time. Coyne taught at Case and John Carroll and Kent State and Akron Universities while studying finance and economics at Case. While attending high school, Coyne rose from stock boy to floor manager and buyer at the J. C. Penney Company. Using his experience, age, education, and background, Coyne has contributed to solution of labor and management problems for decades. After writing his Master’s thesis: “Railroad Proposals for the Alleviation of their Financial Crisis” and receipt of his MBA, Tom worked with Cyrus Eaton at the Chesapeake & Ohio Railway as it acquired the Baltimore & Ohio Railroad, (the combined railroad today is called CSX). Tom appeared before the Interstate Commerce Commission dealing with per diem rate cases of railroad cars. Tom is a licensed pilot. After writing his Ph.D. dissertation, receipt of the degree and having it published by the Legislative Services Committee and distributed by the Committee to each member of the House and Senate and administrative persons in West Virginia, entitled “Banking Structure in West Virginia,” branch banking was adopted by the state of West Virginia. Prior to distribution of the Coyne dissertation West Virginia was the only unit banking state (NO branches allowed) in the nation.


Professor Coyne spent the bulk of his professional career teaching graduate and undergraduate courses (MBA) as a tenured full professor of finance and/or business economics at fully accredited (AACSB) universities. He has traveled extensively throughout Russia, Western Europe, and the United States, lecturing and presenting papers in finance and economics. He has negotiated countless multi-million dollar contracts for scores of American Boards of Education, has created and served as executive director of several foundations in the United States and Europe. Coyne grew financial and real assets for one group from only eleven dollars to $6.0 million before leaving.


Tom has been an active member in his church, in church institutions, and has published at least ten books or monographs, plus about one hundred peer-reviewed articles to be found in many academic & professional journals. His Arbitration Awards are published. Many written contributions have appeared in newspapers and online. Coyne is an arbitrator, serving from the lists of the Federal Mediation and Conciliation Service. He completed the Indianapolis Mini-Marathon for Cancer Research (2002, 2003, 2004, 2005 & 2006), and had a weekly one hour 50,000 watt call-in talk radio show broadcast simultaneously in Cleveland, and Youngstown, Ohio. Tom is an honorably discharged U.S. Army combat infantry veteran, having served with L Company, 180th Infantry Regiment, 45th Infantry Division, Sandbag Castle, Korea, receiving the Korean Service Medal with 2 Bronze Service Stars, the United Nations Service Medal, the National Defense Service Medal, the Combat Infantry Badge (CIB), the Good Conduct Medal, a Letter of Appreciation signed by Kim Dae-jung, President of the Republic of Korea, and The President Syugman Rhee Memorial Association 60th Anniversary Korean War 1950-2010 Medallion.


Tom sought the U.S. Senate seat Ohio (I) being vacated by Howard Metzenbaum, 1994. Ohio Secretary of State denied Coyne placement of the Coyne name on the ballot claiming inability to read 11,000 (approx.) properly prepared signed and printed petition signatures).


Tom sought the Office of Governor West Virginia (I), 2004. WV Secretary of State refused to provide Coyne with appropriate petition forms subsequent to which in Wheeling Federal District Judge Frederick P. Stamp, Jr. declared from his bench WV violated previous (2 years prior) Federal District Court orders of Judge Kelley requiring WV to provide proper petition forms, that WV should have provided Coyne with proper petition forms, but in his written Award Stamp found in favor of WV. U.S. Supreme Court Chief Justice William Hubbs Rehnquist was at his residence outside Washington, D.C. studying Coyne’s appeal of the Judge Stamp “award” the night Rehnquist died.


Thomas Joseph Coyne, Ph.D., was formerly married to Patricia Anne Smith, R.N., of Huntington and together they proudly raised their five children, all of whom are college-educated. Tom and Pat have twelve grandchildren. Tom plans to take the U.S. Senate seat being vacated by Jay Rockefeller (D.WV) in the election of November 4, 2014.

Government is collective oppression

Listen to what the progressive liberal Democrats are saying to you. They tell you that you can’t do stuff without them. That the deck is stacked against you, that you’re simply not good enough to run your own life to make your own choices. I simply don’t agree with them. Conservative libertarians don’t agree with them, we know that you are the best one to run your life. We know that you are the best one to make your own life choices. The only obstacles that are in your way are those obstacles that you have put in your way and that the government has put in your way. If someone is telling you that the deck is stacked against you it is because they are the ones that are holding the cards. If someone is telling you that you can’t do something without them it’s because they’re trying to control. You don’t just listen to what the Democrats are saying for your evidence that they are trying to control you and oppress. You look at what they are doing, government is not freedom and government is not individual responsibility, individual prosperity or individual freedom. Government is collective oppression.
